Did you know that DWSC is required to have the account in the legal landowner’s name? This requirement is stated in the DWSC Tariff, which is published by Texas Rural Water Association (TRWA), adapted for DWSC, approved by the DWSC Board of Directors and then submitted to the Public Utility Commission of Texas (PUCT).
If the account is not in the legal landowner’s name, we simply need to transfer the account. To do this, there is a $50.00 transfer fee and transfer form. If you purchased the land under your name but then deeded it to your children, spouse, friend, sibling, LLC, Limited Partnership, Trust, etc., the account needs to be transferred into the new owner’s name. If the account is under someone who is now deceased, the account needs to be updated to their estate or grantee of the estate.
A Membership Transfer Packet, which can be found on our website needs to be completed by the new owner and we need a copy of the recorded deed, or will and death certificate(s), as proof of ownership. If the deed is in an LLC, Limited Partnership, Trust, etc., we need documentation showing who can sign for the company/trust. We will begin going through our accounts and reaching out to those who are out of compliance and ask that you please update the information.
Why should you update your account? It is important to update your account so you are in compliance with our Tariff, which you agreed to by signing the Service Application and Agreement, and to make sure we have the correct contact information on file. There are times when DWSC will need to call you, such as if there is a leak on your property or a problem with your payment. If we don’t have the correct information on file, we will not be able to get in touch with you. We also will soon have our 2025 Annual Meeting and Elections and if the account is not in your name then you will not be able to participate.
Our Tariff is available to view on our website and is amended from time to time by the Board of Directors. If you need to update your account, you may email the Membership Transfer Packet to [email protected] Once we receive the packet, we will review it and let you know if additional information is needed.
Items needed to transfer an account into the correct member’s name:
- Membership Transfer Form Completed by both Parties and Notarized
- If named member is deceased, please notate
- Copy of Deed showing proof of ownership*Notarized
- New Service Application Form
- Easement
- Personal Disclosure Form
- $50 fee
